Chart Playback Data Tool Terms of Use

These Terms set out the conditions that apply between the Chart Playback operator (the “Operator”) and persons who use Chart Playback Data Tool (the “User”).

Please review and agree to these Terms before using the tool.

Article 1: Application and relationship with the web app

These Terms apply to every user of this tool.

This tool may be used whether or not the user uses the Chart Playback web app. A Chart Playback account or sign-in is not required.

This tool and the Chart Playback web app are related services but are provided separately.

Article 2: Purpose of this tool

This tool retrieves price and similar data for instruments and periods specified by the user and saves it as CSV files on the user’s device.

It assists with obtaining price data and is not intended for the following activities.

  • Directing investment decisions or recommending transactions
  • Forecasting future prices or movements
  • Assuring profits or other outcomes
  • Recommending particular instruments

Users are responsible for decisions and actions using retrieved data.

Article 3: Eligible users and scope of use

Individuals who agree to these Terms may use this tool, including people who do not use the Chart Playback web app. A Chart Playback account or sign-in is not required.

The tool is for non-commercial, non-business use by individuals for themselves, including personal investment decisions, analysis, decision-making practice, research, or record keeping.

Use by corporations, organizations, or sole proprietors for business, for customers or other third parties, or in services that provide data to third parties is outside the scope.

Users must check and comply with terms, rights, and restrictions set by data providers and other third parties.

Being able to use the tool does not mean that retrieved data may be freely copied, published, sold, redistributed, or commercially used.

Article 4: Data sources

This tool uses the third-party open-source software yfinance to retrieve price and similar data.

yfinance is unofficial software. The operator has no affiliation, cooperation, approval, or agency relationship with Yahoo, Yahoo Finance providers, yfinance developers, or other data providers.

Changes to data-source specifications, failures, access restrictions, or discontinued availability may make all or part of the tool unavailable.

Users must check and comply with the latest terms, rights, and restrictions established by data providers and other third parties.

Names, copyright notices, and license terms for third-party software can be checked in third-party license notices bundled with the tool or on the official site.

Article 5: Data accuracy and similar matters

The operator does not assure the following for data retrieved with this tool.

  • Accuracy
  • Completeness
  • Currency
  • Continuing availability
  • Fitness for a particular purpose
  • Absence of missing values, duplicates, or errors

Changes to data sources, failures, restrictions, discontinuation, market closures, instrument-information changes, and other reasons may prevent retrieval or result in data different from what is expected.

Users should compare data with other sources as necessary before use.

Article 6: Storage and transmission of data

CSV files retrieved with this tool are saved to a location on the user’s own device specified by the user.

The tool does not send or store instrument codes, periods, instrument names, or retrieved CSV data entered by users on servers managed by the operator.

However, information corresponding to the instrument code, period, and similar inputs may be sent to the data source to retrieve data.

Users are responsible for managing, backing up, deleting, and providing saved files to third parties.

Article 7: Prohibited conduct

Users must not use this tool for the following conduct.

  • Violating laws or third-party terms
  • Selling, redistributing, publicly transmitting, or publishing retrieved data without necessary rights or permission
  • Using the tool as a commercial, business, or third-party data-provision service
  • Retrieving large volumes of data repeatedly in a short time by automation or other methods
  • Circumventing or attempting to circumvent data-source access restrictions
  • Installing the tool on a server to retrieve data on behalf of third-party requests
  • Imposing excessive load on the tool or third-party services
  • Using the tool for unlawful, improper, or rights-infringing purposes
  • Other conduct the operator finds inappropriate for providing the tool

Article 8: User responsibility

Users are responsible for managing their environment, connection, storage location, and retrieved data.

Before using data retrieved with the tool, users must check its contents, target instrument, period, and whether data is missing.

Users are responsible for transactions, analysis, decisions, and other actions based on use of this tool or retrieved data.

Article 9: Disclaimer and limitation of liability

This tool is provided as it is at the time of provision. The operator does not assure that it works on every device, OS, communication environment, or future environment.

Users may suffer damage due to use of or inability to use the tool, missing, incorrect, delayed, or failed storage of data, data-source specification changes, failures, discontinued availability, or other circumstances related to the tool.

Where the operator is liable for damages by law and the operator’s negligence is limited to ordinary negligence, liability is limited to ordinary and direct damage actually incurred by the user. The operator is not liable for special, indirect, lost-profit, or similar damage.

This limitation does not apply to damage caused by intentional conduct or gross negligence, or where limitation is not permitted by applicable law.

Article 10: Changes to and discontinuation of this tool

The operator may change the tool’s functions, supported environments, data-retrieval methods, or provision details as necessary.

The operator may suspend all or part of the tool without advance notice because of changes or failures at data sources, discontinuation, security issues, or other circumstances.

The operator does not assure continuing provision of the tool.

Article 11: Changes to these Terms

The operator may change these Terms in response to changes in law, tool functions, data-source conditions, operational policy, or other necessary circumstances.

For changes with a material effect on users’ rights or obligations, including scope, prohibited conduct, data storage or transmission, fees, account requirements, disclaimer or liability limits, governing law, or jurisdiction, the agreement version will be updated and users will be asked to expressly agree again after the revised Terms are displayed.

Users who do not agree to a change requiring re-agreement may not use the tool after the change.

Re-agreement may not be required for typographical corrections, terminology consistency, clarification that does not change meaning, contact or link updates, or updates to third-party license notices without a material effect on users’ rights or obligations.

A user’s lack of action or continued launch of the tool alone does not count as agreement to a change requiring re-agreement.

Article 12: Third-party software

This tool includes yfinance and other open-source software provided by third parties.

The license terms for each item apply. Names, copyright notices, and license terms for relevant software can be checked in third-party license notices bundled with the tool or on the official site.

Article 13: Governing law and jurisdiction

Japanese law governs these Terms and matters concerning this tool.

Jurisdiction over disputes concerning this tool follows the Code of Civil Procedure and other applicable laws.

Where another mandatory provision applies by law, that law prevails.
